“Supreme Court Warns of Reselling Amrapali Flats as Buyers Fail to Take Possession”

In a decisive move, the Supreme Court has announced that flats in the Amrapali projects, which remain unclaimed by homebuyers despite repeated efforts, will be sold to new buyers. The state-owned NBCC, responsible for completing the stalled projects, has been tasked with ensuring compliance and expediting construction.

Court Demands Status Report

A bench comprising Justices Bela M. Trivedi and Satish Chandra Sharma directed Attorney General R. Venkataramani, acting as the court-appointed receiver, to submit an updated report on unclaimed flats. “We will request the court receiver to file the latest report where possession has not been taken over by the homebuyers despite efforts by him and the NBCC,” the bench stated.

Approval Granted for Additional Construction

Senior advocate Ravinder Kumar, representing the Noida and Greater Noida authorities, informed the court that the Greater Noida authority had approved the construction of additional flats in the Gold Home Project. For five other projects, certain compliance measures by the NBCC were required.

The NBCC, represented by senior advocate Siddharth Dave, clarified that compliance for four projects—Centurion Park, Leisure Valley, Leisure Park, and Dream Valley—was completed through portal uploads. The court directed the Greater Noida authority to grant approval for the remaining four projects without further delay.

Buyers Risk Losing Bookings

The court expressed frustration with buyers who have not responded to possession offers and warned that their bookings would be canceled. These flats will then be resold to recover funds and streamline project completion.

The Amrapali case, a long-running legal battle, has highlighted systemic issues in real estate, with thousands of homebuyers waiting for years for their investments to materialize. This move signals a turning point, focusing on accountability and timely resolution for pending projects.
