The Supreme Court has approved the Rajasthan law. It is known that this rule has been in force for the last 21 years for Panchayat elections in Rajasthan. Candidates with more than two children cannot contest Panchayat elections in Rajasthan. Now this law has been implemented on government jobs.
According to media reports, the bench of Justice Surya Kant, Justice Dipankar Dutta and Justice KV Vishwanathan has rejected the appeal filed by former soldier Ram Lal Jat. Ex-serviceman Ram Lal Jat retired in the year 2017. Then on 25 May 2018, he applied for the post of constable in Rajasthan Police. This application was later rejected under Rule 24(4) of the Rajasthan Police Subordinate Services Rules, 1989.

What are Rajasthan Various Services (Amendment) Rules, 2001?

Let us tell you that there is a provision under Rajasthan Various Services (Amendment) Rules, 2001 that those who have more than two children on or after June 1, 2002, will not get government jobs. They will not be considered eligible for government jobs.

Why was the ex-serviceman’s petition rejected?

It is known that former soldier Ramlal Jat has more than two children. That is why his candidature for a government job has been rejected. In this regard, former soldier Ramlal Jat had challenged the government’s decision in the Rajasthan High Court. While giving its verdict in October 2022, Rajasthan High Court had refused to intervene in this matter.

Why was such a rule implemented in Rajasthan?

It is noteworthy that Justice Kant’s bench said that a similar provision is also regarding the qualification of candidates in Panchayat elections. In 2003, this was upheld by the Supreme Court in the case of Javed vs. State of Rajasthan. Candidates having more than one child will not be considered eligible under this case. The purpose of this rule is to promote family planning.
